Summary

  • These Terms apply to all Cyphyrix services: the main website, Status Page, Fluxer Bot, Bot Web Panel, and Git instance.
  • You must be at least 13 years old (or meet a higher age requirement in your country) to use our services.
  • The Fluxer Bot and Bot Web Panel operate on top of the Fluxer platform — you must also comply with Fluxer's Terms of Service.
  • We do not sell your data. See our Privacy Policy for details.
  • All Cyphyrix software is open source, released under the MIT licence.
  • Services are provided as-is, without any service-level guarantee — we are a small open source project.
  • These Terms are governed by the laws of England and Wales.

1 Introduction & Acceptance

Welcome to Cyphyrix. Cyphyrix is an open source software project based in the United Kingdom that builds and operates a suite of free, community-focused services. Throughout these Terms, "Cyphyrix", "we", "us", and "our" refer to the Cyphyrix project and its operators.

These Terms of Service ("Terms") form a legally binding agreement between you and Cyphyrix governing your access to and use of all services we operate (collectively, the "Services"), as listed in Section 3. By accessing or using any of our Services you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not use our Services. If any applicable mandatory local law conflicts with these Terms, the mandatory law will prevail to the extent of that conflict.

2 Definitions

For the purposes of these Terms:

  • "Services" means all websites, applications, APIs, bots, and other tools operated by Cyphyrix, including those listed in Section 3.
  • "Account" means a user account registered with a Cyphyrix Service (either directly, such as on the Git instance, or via a third-party login, such as Fluxer OAuth2 on the Bot Web Panel).
  • "User Content" means any data, messages, files, code, repository content, or other material you submit, upload, or otherwise make available through the Services.
  • "Bot" means the Cyphyrix Fluxer Bot operated on the Fluxer platform.
  • "Webpanel" means the Cyphyrix Bot Web Panel available at bot.cyphyrix.xyz.
  • "Git Instance" means the self-hosted Forgejo instance at git.cyphyrix.xyz.
  • "Fluxer" means the Fluxer Platform AB chat service at fluxer.app, on which the Bot operates.
  • "Privacy Policy" means our Privacy Policy available at cyphyrix.xyz/privacy.
  • "GDPR" and "UK GDPR" mean the General Data Protection Regulation as retained and adapted in UK law under the Data Protection Act 2018, and the EU GDPR where it applies to EU residents interacting with our Services.

3 Our Services

Cyphyrix operates the following Services. Each Service may have its own specific rules and data practices, as described below and in our Privacy Policy.

Main Website cyphyrix.xyz

Our public-facing homepage and information site. No account is required. No personal data is collected beyond standard server access logs processed by BunnyCDN.

Status Page status.cyphyrix.xyz

A read-only uptime and incident monitoring page for Cyphyrix services. No account is required. No personal data beyond server logs is collected.

Cyphyrix Bot Source

A feature-rich bot operating on the Fluxer platform. The Bot stores Fluxer usernames, user IDs, guild (server) IDs, song requests, and moderation actions in a MySQL database. Use of the Bot is also subject to Fluxer's Terms of Service.

Bot Web Panel bot.cyphyrix.xyz

A web dashboard for managing the Cyphyrix Bot. Login is provided via Fluxer OAuth2. User profile data received from Fluxer (username, user ID, avatar, guild list) is stored in our database to power the panel.

Git (Forgejo) git.cyphyrix.xyz

Our self-hosted Forgejo instance hosting all Cyphyrix open source code. Users may register an account with a username and email address to file issues, submit pull requests, and contribute. Accounts and repository data are stored in our database.

Note on the Fluxer dependency: The Cyphyrix Bot and Bot Web Panel are built on top of the Fluxer platform, an open source Discord alternative operated by Fluxer Platform AB. By using these Services you are also subject to Fluxer's Terms of Service and Fluxer's Privacy Policy. Cyphyrix is not affiliated with or endorsed by Fluxer Platform AB.

4 Eligibility & Accounts

4.1 Age Requirement

You must be at least 13 years old to use our Services. In some jurisdictions the minimum age is higher (for example, 16 in certain EU member states under GDPR). You are responsible for ensuring your use complies with the laws of your jurisdiction.

If you are under the age of legal majority in your country but at or above the minimum age, your parent or legal guardian must review and agree to these Terms on your behalf. We do not knowingly collect personal data from children below the minimum age. If we become aware that we have done so, we will promptly delete that data and the associated account.

4.2 Account Responsibility

If you create an Account on any of our Services (including via Fluxer OAuth2 on the Webpanel, or by registering directly on the Git instance), you are responsible for:

  • Keeping your login credentials confidential and secure.
  • All activity that occurs under your Account.
  • Providing accurate information at registration and keeping it up to date.
  • Notifying us promptly at hello@cyphyrix.xyz if you believe your Account has been compromised.

You may not create an Account on behalf of someone else without their express consent, or create multiple accounts to evade a ban or restriction.

4.3 Account Security

We strongly recommend enabling two-factor authentication (2FA) where available on the Git instance. You are responsible for the security of the devices you use to access our Services.

5 Acceptable Use

5.1 Permitted Use

You may use our Services for lawful personal, community, and development purposes, consistent with the nature of each Service and these Terms.

5.2 Prohibited Conduct

You must not use our Services to:

  • Violate any applicable local, national, or international law or regulation.
  • Harass, threaten, bully, or harm other users or third parties.
  • Upload, transmit, or distribute malware, viruses, or any other harmful code.
  • Attempt to gain unauthorized access to our systems, servers, databases, or other users' accounts.
  • Conduct large-scale automated scraping, harvesting, or indexing of our Services without prior written permission.
  • Distribute or host illegal content, including but not limited to child sexual abuse material (CSAM). Any such content will be reported to the relevant authorities (including the Internet Watch Foundation and NCMEC).
  • Impersonate any person, organization, or entity, including Cyphyrix staff.
  • Use the Bot or Webpanel in a way that violates Fluxer's Terms of Service.
  • Deliberately attempt to stress-test, overload, or degrade our infrastructure.
  • Use our Services for spam, unsolicited advertising, or any other form of platform abuse.
  • Circumvent or attempt to circumvent any security or access controls we have put in place.

5.3 Moderation on the Bot

Guild (server) administrators who add the Bot to their Fluxer servers are responsible for ensuring that their moderation actions using the Bot comply with these Terms, all applicable laws, and Fluxer's Community Guidelines. Cyphyrix may remove the Bot from servers that are found to be using it for abusive or unlawful moderation practices.

6 User Content & Intellectual Property

6.1 Your Content

You retain ownership of all User Content you create and submit through our Services (for example, code repositories, issues, and pull requests on the Git instance, or configuration data on the Webpanel).

By submitting User Content to our Services, you grant Cyphyrix a limited, non-exclusive, royalty-free licence to host, store, reproduce, and display that content solely to the extent necessary to operate the relevant Service. We will not use your User Content for any other purpose without your consent.

6.2 Code Contributions

Code contributed to Cyphyrix repositories on the Git instance is subject to the MIT licence (or the licence applicable to that specific repository, as stated in its LICENSE file). By submitting a pull request or contributing code, you confirm that you have the right to do so and agree that your contribution will be licensed under the same licence as the project.

6.3 Cyphyrix Intellectual Property

All Cyphyrix software is open source and released under the MIT licence. You are free to use, copy, modify, merge, publish, distribute, sublicense, and/or sell copies of our software subject to the terms of the MIT licence. Our trademarks, service marks, logos, and trade names ("Cyphyrix Marks") are not included in the MIT licence grant — please contact us at hello@cyphyrix.xyz if you wish to use them.

6.4 Copyright Infringement

If you believe content on our Services infringes your copyright, please contact us at hello@cyphyrix.xyz with a description of the work you claim has been infringed, the URL of the allegedly infringing material, and your contact details. We will respond in a timely manner and, where appropriate, remove or disable access to the content.

7 Third-Party Services & Dependencies

Cyphyrix relies on a number of third-party services to operate our infrastructure. Your use of our Services may involve your data being processed by these providers, as described in our Privacy Policy.

7.1 Fluxer Platform

The Cyphyrix Bot operates on the Fluxer platform (operated by Fluxer Platform AB), and the Bot Web Panel uses Fluxer OAuth2 for authentication. By using these Services, you also agree to be bound by Fluxer's Terms of Service. Cyphyrix is not affiliated with or endorsed by Fluxer Platform AB.

7.2 BunnyCDN

We use Bunny.net (BunnyCDN) to provide DNS management and content delivery network (CDN) services. Traffic to our websites may be routed through BunnyCDN's network. Use of our Services is therefore also subject to BunnyCDN's Terms of Service.

7.3 Hosting Providers

Our servers are hosted by OVH (European data centres) and Interserver.net (United States data centres). Your data may be stored and processed on infrastructure operated by these providers. See our Privacy Policy for more details on how we handle international data transfers.

7.4 Third-Party Responsibility

Third-party services have their own terms of service and privacy policies, separate from ours. Cyphyrix is not responsible for the content, availability, or practices of any third-party service. We encourage you to review the terms of any third-party service you use in connection with our Services.

8 Privacy & Data Protection

We take your privacy seriously. Our Privacy Policy explains in full what personal data we collect across each of our Services, why we collect it, how we use it, who we share it with, and the rights you have under UK GDPR and related legislation.

In summary:

  • We do not sell, rent, or trade your personal data to any third party.
  • We collect only the data needed to operate and secure each Service.
  • You have rights of access, rectification, erasure, portability, restriction, and objection under UK GDPR.
  • You can contact us about your data at privacy@cyphyrix.xyz.

Where there is any conflict between these Terms and the Privacy Policy in relation to the handling of personal data, the Privacy Policy will take precedence.

9 Open Source Software

All software developed by Cyphyrix is published as open source under the MIT licence at git.cyphyrix.xyz. This means you are free — at no cost — to use, copy, modify, merge, publish, distribute, sublicense, and sell copies of our software, subject to the MIT licence conditions.

The MIT licence does not require you to open-source your own changes or derivative works, and there is no "copyleft" obligation. Attribution (retaining the copyright notice) is required.

Nothing in these Terms restricts your rights under the MIT licence. The MIT licence grant applies specifically to the software source code; it does not grant any rights to our trademarks or to use the Cyphyrix name to endorse products derived from our software without prior written permission.

10 Disclaimers & Limitation of Liability

10.1 Services Provided "As Is"

Cyphyrix is a small, volunteer-driven open source project. Our Services are provided on an "as is" and "as available" basis. We do not offer any service-level agreement (SLA) and we make no warranty, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or uninterrupted or error-free operation.

We cannot guarantee 100% uptime or availability. Outages, scheduled maintenance, and unexpected downtime may occur. The Status Page at status.cyphyrix.xyz provides real-time service health information.

10.2 Limitation of Liability

To the maximum extent permitted by applicable law, Cyphyrix and its contributors will not be liable for any indirect, incidental, consequential, special, or punitive damages, or any loss of data, profits, revenue, or goodwill, arising from or in connection with your use of or inability to use the Services, regardless of whether we have been advised of the possibility of such damages.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable UK law.

If you are a consumer in the UK or EEA, these limitations apply only to the extent permitted by mandatory consumer protection law and do not affect your statutory rights.

10.3 Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Cyphyrix and its contributors from any claims, damages, and costs (including reasonable legal fees) arising from your violation of these Terms, your violation of any applicable law, or your User Content.

11 Account Termination

11.1 Voluntary Termination

You may close your accounts and delete your data on our Services at any time:

  • Bot Web Panel — you can delete your Webpanel account and all associated data directly through the panel account settings at bot.cyphyrix.xyz.
  • Server / guild data (via the Webpanel) — guild administrators can delete all Bot data associated with their server through the Webpanel. Note that doing so will also remove the Bot from your server. This cannot be undone; the Bot must be re-added separately if you wish to use it again.
  • Git instance — you can delete your Forgejo account via the account settings at git.cyphyrix.xyz. Please be aware that your commit history, issues, pull requests, and other contributions will remain in the repository record after deletion — this is inherent to how version control systems work.

11.2 Termination by Cyphyrix

We reserve the right to suspend or terminate your access to any or all Services, with or without prior notice, if we reasonably believe that you have:

  • Violated these Terms or any applicable law.
  • Engaged in conduct that is harmful to other users, third parties, or the integrity of our Services.
  • Used the Services for abusive, fraudulent, or malicious purposes.
  • Violated Fluxer's Terms of Service in a way that affects our Services.

Where practicable, we will provide notice before taking action and give you an opportunity to respond. If you believe a suspension or termination was made in error, contact us at hello@cyphyrix.xyz.

11.3 Effect of Termination

On termination, your right to use the relevant Service will immediately cease. Data deletion will occur in accordance with our Privacy Policy. Certain data may be retained where required by law.

12 Future Paid Services

All Cyphyrix Services are currently provided free of charge. We may, in the future, introduce optional paid features or donation mechanisms to help support the project. Any such changes will be:

  • Communicated in advance with adequate notice.
  • Clearly optional — no currently free features will be placed behind a paywall without prior announcement.
  • Governed by additional terms (such as refund and payment policies) that will be presented to you at the time of any transaction.

These Terms will be updated to reflect any such changes before they take effect.

13 Changes to These Terms

We may update these Terms from time to time to reflect changes to our Services, legal requirements, or our practices. When we make material changes, we will:

  • Update the "Last updated" date at the top of this page.
  • Where practicable, provide at least 30 days' advance notice via a notice on our website or, where appropriate, by email.

Your continued use of our Services after updated Terms take effect constitutes your acceptance of those changes. If you do not agree to the updated Terms, you should stop using the relevant Services.

Prior versions of these Terms may be viewed in the Website source repository on our Git instance.

14 Governing Law & Jurisdiction

These Terms and any disputes arising out of or in connection with them or our Services are governed by the laws of England and Wales, without regard to conflict-of-law rules.

Subject to the paragraph below, any dispute shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer residing in another part of the United Kingdom (Scotland or Northern Ireland) or in the European Economic Area (EEA), you retain any mandatory right under applicable local law to bring claims in the courts of your country or region of residence. Nothing in these Terms limits those mandatory rights.

We encourage you to contact us at hello@cyphyrix.xyz before initiating any formal legal proceedings, so that we can attempt to resolve the matter informally.
